Landlords and developers could be due tax rebate over uninhabitable properties

Landlords and developers in the UK are being urged to seek advice about potential stamp duty rebates following landmark court case relating to uninhabitable property and the 3% stamp duty charge on additional homes.The case, between P N Bewley Ltd and HMRC, held that properties that are not immediately habitable at the time of completion do not constitute a being a ‘dwelling’ for the purpose of the Finance Act 2003.
