Understanding Property Management Law - Tenant Lease Defaults and Landlord Options

Landlords should have a provision in their lease that states that notice of non-payment of rent is waived. If that clause is contained in the lease, then it becomes a business decision on the part of the landlord regarding when to turn a defaulting tenant over to the attorney for eviction. If this clause is not contained in the lease, then a notice of default must first be sent to the resident before legal proceedings can be initiated.
